Kane County Circuit Judge John Barsanti ruled on Tuesday that the state did not meet its burden of proof and found a St. Charles businessman not guilty on all counts.

The bench trial began Monday for St. Charles businessman Robert Gutierrez, 75, who was charged with more than $100,000 in theft by deception.

Brandon Franklin, 18, of the 16900 block of Crane Road, Hazel Crest, is charged with two felony counts of first-degree murder in the March 2023 shooting
